1. Acceptance of Terms
By accessing or using the Acuity Mental Fitness application ("the Service"), operated by Octyra Ltd, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. User Accounts
- Account Creation: To access certain features, you must create an account. You agree to provide accurate, current, and complete information during the registration process.
- Account Responsibility: You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
- Termination: We may terminate or suspend your account at our discretion, without prior notice, for conduct that violates these Terms or is otherwise harmful to the Service or other users.
3. Billing and Subscriptions
- Manual Billing: All billing for subscription services is handled manually via invoices. We do not store any credit card information on our servers, and we do not have an automated billing system.
- Invoicing: Invoices will be sent to the designated billing contact for your organization. Payment terms will be specified on each invoice.
- Subscription Term: Subscriptions are billed monthly or annually, as agreed upon. Your subscription will not automatically renew. We will contact you with a new invoice to continue your service.
- Cancellation: You may cancel your subscription at any time by contacting us directly. Please note that we do not offer refunds for partial subscription periods.
4. Use of the Service
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service.
Prohibited behavior includes:
- Attempting to gain unauthorized access to our systems or engage in any activity that disrupts, diminishes the quality of, or interferes with the performance of the Service.
- Using the Service for any commercial solicitation or purpose without our express written consent.
- Reverse-engineering, decompiling, or otherwise attempting to discover the source code of the Service.
5. Intellectual Property
All content and materials available on the Service, including but not limited to text, graphics, website name, code, images, and logos, are the intellectual property of Octyra Ltd (trading as Acuity Mental Fitness) and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display, or transmission of any content on this site is strictly prohibited unless specifically authorized by us.
6. NOT A MEDICAL SERVICE (IMPORTANT)
Acuity Mental Fitness is a tool for cognitive engagement and entertainment purposes only. The "AI-generated insights" and feedback are not medical diagnoses, clinical assessments, or health advice.
We do not claim to treat, cure, or prevent any neurological or psychological condition (e.g., Alzheimer’s, Dementia, ADHD).
Always seek the advice of a physician or qualified health provider with any questions regarding a medical condition.
Reliance on any information provided by the Service is solely at your own risk.
7. Disclaimers
The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of the Service or the information, content, or materials included therein. You expressly agree that your use of the Service is at your sole risk.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects in the Service will be corrected.
8. Limitation of Liability
To the maximum extent permitted by law, Octyra Ltd shall not be liable for any damages exceeding the total amount paid by the user to Octyra Ltd in the last six months, or £50 (whichever is greater). This includes, but is not limited to, emotional distress, loss of data, or cognitive frustration.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of London, UK.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
